New Overtime and Classification Changes for Small Business Owners

Newark, Delaware – Changes on how small businesses pay their employees in the form of new federal regulations regarding overtime pay and classification of workers will go into effect on December 1, 2016.

The Delaware Procurement Technical Assistance Center (PTAC), in partnership with the United States Department of Labor, will address these changes during a seminar “How Executive Order 13658 Will Change the Way You Pay Your Employees,” on Wednesday, September 28 from 9 a.m. until 12 noon at the Delaware Biotechnology Institute in Newark.  Registration is required along with a $25 fee.

The seminar will cover the following topics:

  • How various laws (Fair Labor Standards Act, Davis Bacon Act and Service Contract Act) set standards for minimum wage, overtime, recordkeeping, fringe benefits, wage exemptions and determinations, and how this new regulation will change those standards;
  • How the Overtime Final Rule Update will define and delimit the exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees under the Fair Labor Standards Act; and
  • The impact of Executive Order 13658, “Establishing a Minimum Wage for Contractors” on businesses that have contracts with the federal government.

Juanita Beauford, Program Director of PTAC said: “Some businesses are not aware of the upcoming changes.  The goal of the PTAC of Delaware and the Small Business Development Center is to ensure businesses in Delaware are in compliance.  The best way to get this information out would be to host the U.S. Department of Labor to Delaware to discuss these changes during the seminar.”

PTAC is a unit of the University of Delaware’s Office of Economic Innovation and Partnerships (OEIP), a team guided by a singular purpose to drive the University and the State’s entrepreneurial, technology and business community to new levels of economic development. PTAC provides a range of expert counseling and trainings focused on helping small businesses conduct business with local, state and federal government entities.  The PTAC program is a public/private partnership with the Defense Logistics Agency, the State of Delaware and the University of Delaware.
